Gründungsherausgeber sind: Erhard Scheibe (Herausgeber bis 1991), Günther Patzig (bis 1999) und Wolfgang Wieland (bis 2003). Von 1990 bis 2007 wurde die Reihe von Jürgen Mittelstraß mitherausgegeben.

English summary: 'Metamorphoses of the holy' denotes the changing aesthetic presentation of the sacred which is connected to the creation and institutionalization of religion as art. The focus of the essays in this volume is the structure and dynamic of this process, something which affects all art genres. The sacralization of aesthetic subjectivity is prerequisite to religion as art as evidenced by the belief in the partaking of the sacred through aesthetic experience. On the basis of aesthetic subjectivity's sacralization, it (...) becomes possible to interpret its various forms of expression as witnesses to the holy and award them a fitting reception. These contributions dedicate themselves to an interdisciplinary scrutiny of religion as art and its cross-points of reference with political and civil religion. The life and work of Hermann Günther Graßmann (1809–1877) attract not only ever again the attention of mathematicians, mathematical historians and those interested in the history of mathematics, they constitute also a challenge for the methodology of historiographical research. This challenge persists since Friedrich Engel’s biography of 1911; there, two sources were presented and interpreted in a not legitimate manner which even mislead since then various scholars. This paper faces the intricate task to unravel not only the methodological shortcomings (...) of Engel’s biography, but also to re-assess the misinterpretations – particularly of alleged influences on Graßmann’s approaches – induced by Engel’s misleading claims. Based upon broader historically contextualised analyses of Graßmann’s innovative elements in his theory of extension and upon new primary sources for his student times at the Gymnasium and Berlin University, the paper presents a novel assessment of Graßmann’s approaches. Ist Geschichtsdarstellung ein transparentes Fenster zu einer faktischen Vergangenheit? Oder verlieren Fakten ihre Verbindlichkeit zugunsten der Repräsentation? Der vorliegende Band weist einen vermittelnden Weg zwischen diesen Extremen. Jenseits der positivistisch verstandenen historischen Fakten sowie der infolge des linguistic turn häufig behaupteten Unzugänglichkeit und Unentscheidbarkeit der faktischen Vergangenheit wird die Geschichtsdarstellung selbst als das eigentlich Greifbare zur Geltung gebracht. Geschichte ist demnach in ihrer Darstellung zu suchen – unabhängig davon, ob es sich um historiographische Quellen, literarische Texte, Gemälde oder um Museen (...) als mediale Darstellungsräume handelt. Die Beiträge gehen einem breiten Spektrum unterschiedlicher Dimensionen von Geschichtsdarstellung nach. Medien, Methoden und Strategien bilden dabei die zentralen Koordinaten, anhand derer Geschichtsdarstellung mit ihren narrativen und bildlichen Ausdrucksformen exemplarisch erörtert wird. Science-fiction (SF) has become a reference point in the discourse on the ethics and risks surrounding artificial intelligence (AI). Thus, AI in SF—science-fictional AI—is considered part of a larger corpus of ‘AI narratives’ that are analysed as shaping the fears and hopes of the technology. SF, however, is not a foresight or technology assessment, but tells dramas for a human audience. To make the drama work, AI is often portrayed as human-like or autonomous, regardless of the actual technological limitations. Taking (...) science-fictional AI too literally, and even applying it to science communication, paints a distorted image of the technology's current potential and distracts from the real-world implications and risks of AI. These risks are not about humanoid robots or conscious machines, but about the scoring, nudging, discrimination, exploitation, and surveillance of humans by AI technologies through governments and corporations. AI in SF, on the other hand, is a trope as part of a genre-specific mega-text that is better understood as a dramatic means and metaphor to reflect on the human condition and socio-political issues beyond technology. Niklas Luhmann and Jacques Derrida start with a common assumption in their analyses of the law and the economy - the foundational paradox of social institutions. But then autopoiesis and deconstruction move into opposite directions. Luhmann pursues the question of how de-paradoxification constructs the immanence of social institutions and builds a world of autopoietic social systems. By contrast, Derrida's thought aims at the transcendence of social institutions through their re-paradoxification. However, there is a hidden supplementarity of autopoiesis and deconstruction which (...) makes it worthwhile to relate the theories to each other. Derrida's distinction of writing/speech is necessarily blind toward Luhmann's distinction of consciousness/communication, but is, at the same time, continuously provoked by it. On another level, the opposite happens. Luhmann's autopoiesis is permanently irritated by Derrida's différance but is at the same time unable to conceptualize it. This complementary blindness of their distinctions directrices is a permanent source of mutual irritation which requires a reformulation of the social and of the possibility of justice. (shrink)

Globalization processes imply the self-deconstruction of the hierarchy of legal norms. Thus, legal pluralism is no longer only an issue for legal sociology, but becomes a challenge for legal practice itself. Traditionally, rule making by `private regimes' has been subjugated under the hierarchical frame of the national constitution. When this frame breaks, then the new frame of legal institutions can only be heterarchical. The origin of global non-state law as a sequence of recursive legal operations is an `as if', not (...) only a founding myth as a self-observation of law, rather the legal fiction of concrete past operations. This fiction, however, depends on social conditions outside legal institutions, on a historical configuration in which it is sufficiently plausible to assume that in earlier times, too, legal rules were applied. In the sixth century BC, Pherekydes of Syros, the reputed teacher of Pythagoras and contemporary of Thales and Anaximander, wrote a book about the birth of the gods and the origin of the cosmos. Considered one of the first prose works of Greek literature, Pherekydes' book survives only in fragments. On the basis of these as well as the ancient testimonies, the author attempts to reconstruct the theo-cosmological schema of Pherekydes. An introductory chapter on the life of Pherekydes is followed (...) by four chapters on the contents of his book. From Pherekydes' mythopoeic creation account, his colourful narratives of a divine marriage and a battle of the gods, and finally from his remarks on the soul, Professor Schibli is careful to unfold the philosophical implications. Pherekydes emerges as a figure who moved in that fascinating frontier between myth and philosophy. The theogonies of Hesiod and the Orphics, the cosmological speculations of certain Presocratics, and the Pythagorean tenets on the soul are all profitably compared with the remnants of Pherekydes' book. Pherekydes is thus shown to be an important witness to early Greek thought in its various manifestations. This is the first book-length study in English dedicated to Pherekydes. It includes a comprehensive appendix of the fragments and ancient testimonies, along with limited critical apparatus and English translations. (shrink)

What are the consequences of modernity for the institution of contracting? As the unity of the traditional contract is dissolved into a multiplicity of separate contracting worlds, the binding force of contracting needs to be reformulated from an interpersonal to an interdiscursive relation. The central thesis of this Article is that the unity of contracting is hidden in the blind spot of the distinction between contracting worlds. Contracting needs two diametrically contradictory but complementary theories which cannot be integrated into a (...) synthesis. As demonstrated with the example of the expertise contract, the subtle interplay of different contracting worlds depends basically on a fragile symmetry of chances of translation. The normative correlate of contract understood as translation between different worlds of meaning would be an extension of constitutional rights into the context of private governance regimes. Die Randverweise auf die Paginierung der Gesamtausgabe der überlieferten Werke Aristoteles' von Immanuel Bekker (Berlin 1831-1870), nach der üblicherweise zitiert wird, ermöglichen ein leichtes und schnelles Auffinden gesuchter Textstellen.
